State baseball tournament an Eldred family experience

MOUNT VERNON ? As young boys, they?d stand in center field at Busch Stadium for batting practice and help field flies and grounders.

Jim Edmonds was their buddy, someone who always took the time to talk to them and give them pointers. They?d walk into the clubhouse, and guys like Albert Pujols and Scott Rolen would say hello to them.

For C.J. and Luke Eldred, these were the perks of having a father in the big leagues.

?We were born and raised around it,? Luke Eldred said. ?It?s part of us.?

Baseball is the Eldred family game, no doubt, though the tables haved turned. Now dad is the spectator, his boys the players.

Cal Eldred retired in 2005 after parts of 14 seasons as a major league pitcher. He still works for the St. Louis Cardinals and is an assistant coach for Mount Vernon High School when his schedule permits.

C.J. is a senior for the Mustangs, Luke a freshman.

?We grew up in the outfield shagging balls together in the Cardinals stadium, old Comiskey (Park) and Milwaukee,? C.J. Eldred said. ?I think it?s cool that we?ve kind of reversed roles in a way. Dad played, and we watched him. Now we?ve switched around, and he watches us. That?s pretty cool.?

Cal Eldred wouldn?t have it any other way.

?I?m all for it,? he said. ?I had a great opportunity that lasted way longer than most. Now I have the chance to sit back and watch them play and encourage them.?

Mount Vernon (26-14) plays Roland-Story (27-13) in a Class 2A state tournament quarterfinal Monday at noon. You bet Cal Eldred will at Principal Park in Des Moines, in the dugout aiding head coach Jeremy Elliott.

C.J. will be at first base and hitting second in the batting order. Luke will be there for moral support only, in uniform but on crutches after breaking his hip on a swing, of all things, during a game in early July.

?It?s bittersweet,? Luke said. ?It?s good to see C.J., good to see the team going to state. At the same time, I wish I was there and helping.?

?When he hurt himself, I was actually standing on first base,? C.J. Eldred said. ?It?s kind of funny because we?ve only played about 15 games together, even though we?ve been on the same team for two years ? I was having a good time standing over there at first and taking throws from him at third. Giving him a hard time about what he?s doing out on the field. So, yeah, this is bittersweet. I wish he could play. At least he?s here with us.?

Luke played on Mount Vernon?s varsity last season as an eighth-grader, but it was C.J. that only got into only eight games because of injury issues. He?s had surgeries the last two Januaries (with an eight-inch plate and 10 screws still in his leg) to repair a right kneecap that continued to shift out of place, then a broken bone in his lower right leg.

He?s headed to Indiana University this coming fall to pitch, though he didn?t throw for Mount Vernon this season so he could fully heal. His unabashed goal is to follow his dad to the bigs.

?They?ve been through a lot,? Cal Eldred said of his son?s injuries. ?These are great life lesson that sports can give you.?

C.J., Luke and their three younger sisters (Emily, Abby and Holly) have been home schooled over the years by mom, Christi. It was never difficult to get the boys to complete their daily lessons because there always was an agreement.

Whitecaps lose second straight match as Hoppenot leads Union to 1-0 win

Dartmouth College under investigation for sexual harassment allegations

Dartmouth College is being investigated by the U.S. Department of Education over its response to sexual harassment allegations on campus.

Steven Spector, the department's assistant press secretary, said the department's Office of Civil Rights initiated a compliance review of Dartmouth for sexual harassment grievance procedures and potential violations of Title IX. That law forbids gender discrimination among schools that receive federal aid.

Spector told the Valley News the government has recently looked into a series of similar cases at other colleges.

Dartmouth spokesman Justin Anderson said the college is cooperating with the investigation. He said Dartmouth has focused on prevention and education and worked to strengthen its policies.

Clear Channel adds talk to iHeartRadio

(AP) ? Clear Channel says it is adding talk shows and listener-generated content to iHeartRadio, expanding the online radio service's offerings beyond music.

Clear Channel, which operates more than 850 terrestrial radio stations as well, said Wednesday that users who update their iHeartRadio apps on the iPhone and Android phones will be able to search for talk shows on those phones. For now, iHeartRadio Talk is only available on the Web, but the company says it's coming to mobile phones in September.

Clear Channel says users can access talk shows such as "Good Morning America," ''Direct from Hollywood" with Ryan Seacrest, Rush Limbaugh's "Rush Daily Update Minute" and TED Talks.

Users will also be able to submit their content that iHeartRadio may feature alongside established shows.

By directing energy beams at tiny crystals found in a Martian meteorite, a Western University-led team of geologists has proved that the most common group of meteorites from Mars is almost 4 billion years younger than many scientists had believed resolving a long-standing puzzle in Martian science and painting a much clearer picture of the Red Planet's evolution that can now be compared to that of habitable Earth.

In a paper published today in the journal Nature, lead author Desmond Moser, an Earth Sciences professor from Western's Faculty of Science, Kim Tait, Curator, Mineralogy, Royal Ontario Museum, and a team of Canadian, U.S., and British collaborators show that a representative meteorite from the Royal Ontario Museum (ROM)'s growing Martian meteorite collection, started as a 200 million-year-old lava flow on Mars, and contains an ancient chemical signature indicating a hidden layer deep beneath the surface that is almost as old as the solar system.

The team, comprised of scientists from ROM, the University of Wyoming, UCLA, and the University of Portsmouth, also discovered crystals that grew while the meteorite was launched from Mars towards Earth, allowing them to narrow down the timing to less than 20 million years ago while also identifying possible launch locations on the flanks of the supervolcanoes at the Martian equator.

More details can be found in their paper titled, "Solving the Martian meteorite age conundrum using micro-baddeleyite and launch-generated zircon."

Moser and his group at Western's Zircon & Accessory Phase Laboratory (ZAPLab), one of the few electron nanobeam dating facilities in the world, determined the growth history of crystals on a polished surface of the meteorite. The researchers combined a long-established dating method (measuring radioactive uranium/lead isotopes) with a recently developed gently-destructive technique at UCLA that liberates atoms from the crystal surface using a focused beam of oxygen ions.

Moser estimates that there are roughly 60 Mars rocks dislodged by meteorite impacts that are now on Earth and available for study, and that his group's approach can be used on these and a much wider range of heavenly bodies.

"Basically, the inner solar system is our oyster. We have hundreds of meteorites that we can apply this technique to, including asteroids from beyond Mars to samples from the Moon," says Moser, who credits the generosity of the collectors that identify this material and make it available for public research.

Morsi's family lashes out at Egypt's military

CAIRO?The family of ousted Egyptian President Mohammed Morsi accused the country's military generals Monday of "kidnapping" him, and said that it holds the army responsible for his "safety and security."

The statement is the first from Morsi's family since the military overthrew him on July 3 and took him into custody. Morsi has been held incommunicado since then. Government officials say he is safe and is being held for his own protection.

"We hold the leaders of the bloody military coup fully responsible for the safety and security of the president," the family said in a statement read out by Morsi's daughter, Shaimaa.

One of Morsi's sons, Osama, described his father's detention as the "embodiment of the abduction of popular will and a whole nation," and said the family will "take all legal actions" to end his detention.

"What happened is a crime of kidnapping," said Osama, who is a lawyer. "I can't find any legal means to have access to him."

He said that the family met with Morsi for the last time on July 3, shortly before his ouster. Since then, they have had no contact with him.

"We warn Abdel-Fatah el-Sissi and his coup leaders against harming the life, health or safety of the legitimate President, our father," he added.

El-Sissi, the country's defense minister and army chief, led the military's ouster of Morsi after four days of mass protests demanding the president step down.

Speaking at the same news conference, the secretary-general of the doctor's syndicate, Gamal Abdel-Salam, said the union has asked the military to grant doctors access to Morsi to check his health. He said the deposed president suffers from diabetes and liver problems.

Morsi's son, however, denied that his father has health problems.

The Muslim Brotherhood, from which Moris hails, and his Islamist allies have held near daily street protest in Cairo and across the country to demand that he be reinstated.

Detroit bankruptcy lawyers' track records range from Chrysler to Major League Baseball

Detroit's bankruptcy started with a mad dash to a federal courthouse, much as Orange County, California's did in 1994, when it undertook a billion-dollar restructuring.

A difference between the two cases is their size. Orange County went into court with $1.7 billion in losses from a $7.5 billion investment pool it controlled, while Detroit's July 18 filing listed $18 billion in debt, a record for a U.S. municipal bankruptcy.

What they shared was a need for speed and the lawyer who led the way: Bruce Bennett, the Los Angeles-based bankruptcy attorney who helped push both filings into court to shield his clients from potentially disruptive actions by creditors.

Detroit sought bankruptcy protection after decades of population decline and dwindling manufacturing jobs left it too poor to pay bondholders, retired cops and current city workers. It filed its petition minutes before a state judge could rule on requests by the workers and retirees to bar the city from bankruptcy.

Almost 20 years earlier, when Orange County anticipated an uncontrollable rush by creditors to withdraw money from the pool, Bennett and his colleagues put the municipality under court protection, according to attorney Lee Bogdanoff, who worked with him on the case.

Bennett, 54, and his colleague David Heiman, 68, are now in charge of Detroit's day-to-day legal strategy, which for the next four months will focus on defending Gov. Rick Snyder's decision to file. They are partners at Jones Day, a firm with more than 2,400 lawyers worldwide.

The two have been working out of the spotlight, which so far has been trained on the governor and Kevyn Orr, who was a partner at Jones Day when Snyder named him as Detroit's emergency manager in March.

The focus may shift to Bennett, Heiman and the rest of their legal team when they enter the federal courthouse in downtown Detroit tomorrow, the date they have requested for an initial hearing. Heiman is the case manager, while Bennett will lead the litigation and debt-restructuring efforts, Orr's spokesman, William Nowling, said in a text message.

Chapter 9

Detroit filed under the U.S. Bankruptcy Code's Chapter 9, which is reserved for municipalities and the rules of which differ from those imposed on companies in Chapter 11. Unlike companies, municipalities don't need to ask the bankruptcy court for permission to pay any bills they ran up before filing for court protection, including wages, utilities and rents.

While under court protection, Detroit can stop paying some debts, is temporarily immune from most lawsuits and may be able to ask a judge to cancel contracts, including union agreements.

The first key job for Bennett and Heiman will be to fend off the city unions, pension managers and bondholders that don't want Detroit to have the court's protection.

When Orange County filed what was then the biggest U.S. municipal bankruptcy, Bennett developed a strategy that quickly returned cash to other government agencies that had money in the investment pool, said Bogdanoff, of Klee Tuchin Bogdanoff & Stern LLP in Los Angeles.

Paying creditors

That decision helped prevent smaller agencies from following Orange County into bankruptcy. Bennett also decided that the county would borrow money in the middle of the case to help pay creditors, something that hadn't been done before, Bogdanoff said.

The county also sued Merrill Lynch & Co. to cut losses in the $7.5 billion fund. To settle claims over derivatives-trading losses that had led to the bankruptcy, Merrill, now a unit of Bank of America Corp., paid $400 million to the county and creditors who had put money into its investment pool.

All creditors were fully repaid, Bogdanoff said.

Heiman is a senior figure in U.S. bankruptcy circles, "a dean of the national bankruptcy bar," said Derek Abbott, a lawyer at Morris, Nichols, Arsht & Tunnell LLP in Wilmington, Delaware. "He's very polished."

Heiman has handled corporate restructurings including the bankruptcies of Federated Department Stores and Chrysler LLC.

'Go Dodgers'

All his cases have prepared him for his latest job, Heiman said in an e-mail. "I do like Michigan, and Detroit, so maybe Chrysler helped in that respect. What really prepares is being on a great, cause-oriented team."

Joe Farnan, a retired federal judge, said Bennett is one of the five best bankruptcy lawyers working today, with a gift for creative legal solutions, although he's not always the best man to sell those ideas to a reluctant client who may need soothing.

"He's not fuzzy and warm," Farnan said in an interview.

Bennett declined to comment for this story.

During the bankruptcy of Major League Baseball's Los Angeles Dodgers, Bennett came up with a way to lock in the value of future TV rights, said Farnan, who was the court-appointed mediator on the case. The solution made the Dodgers so valuable that real estate developer Frank McCourt agreed in 2011 to sell rather than fight to keep the franchise, Farnan said.

The team was sold for about $2 billion to a group that included Guggenheim Partners LLC and its top executive, Mark Walter, as well as Magic Johnson, the Hall of Fame basketball player. When the deal was signed, Johnson gave Bennett a Los Angeles Lakers jersey with the words "Go Dodgers" on the back.

In defending Detroit's right to stay in bankruptcy, Heiman and Bennett will prepare for a proposed court hearing this fall the same way non-bankruptcy lawyers get ready for a trial: interviewing witnesses under oath, collecting documents and providing information to creditors about why the city filed.

To keep Detroit under court protection, the pair will need to convince U.S. Bankruptcy Judge Steven W. Rhodes that the bankruptcy petition was filed in good faith and that the city either made a reasonable effort to negotiate with creditors, or that talks weren't practical.

Rhodes, 64, is a 28-year veteran of the bench and a co- author of a book on the law of unraveling Ponzi schemes. He presided over the bankruptcy case of auto-parts maker Collins & Aikman Corp. and also served as chief judge of the Detroit bankruptcy court when it changed its rules at the end of 2008 to make it a more attractive venue for carmakers seeking to reorganize.

The judge keeps cases moving and won't be swayed by public opinions aroused by a high-profile case, said Judy Calton, a bankruptcy partner at Honigman Miller Schwartz & Cohn LLP in Detroit. "He'll keep people's feet to the fire."

Heiman, who grew up in Cincinnati and got his law degree from the University of Cincinnati, is based in Cleveland, where he founded Jones Day's bankruptcy division in 1984.

Bennett grew up in New City, a suburb of New York, and attended Harvard Law School. He joined Jones Day 15 months ago, after his previous law firm, Dewey & LeBoeuf LLP, failed.

Both men are married fathers of two.

Jefferson County

Jones Day was hired by Detroit over Klee Tuchin, which is handling the $4 billion bankruptcy of Jefferson County, Alabama.

Leading a major case like Detroit's can be exhilarating and exhausting, said Kenneth Klee, the lawyer in charge of Jefferson County's case.

In June, Jefferson County announced a settlement with JPMorgan Chase & Co., a group of hedge funds and bond insurers that would cut debt by more than $1 billion by imposing the biggest losses on creditors ever in a Chapter 9 bankruptcy.

The proposal, which has the support of creditors that hold a majority of the county's $3 billion sewer warrants, goes before a court for approval in November, which would allow the county to exit bankruptcy by the end of the year, about two years after it filed.

While Orr has said he hoped Detroit would emerge from bankruptcy by the late summer or fall of 2014, Klee said the city's case will probably last three years.

"It is very, very satisfying work," Klee said. "It is demanding. It takes a huge physical toll. It takes a toll on your relationships and your families."

The tipping point in the war on leaks

The United States government has faced criticism for its aggressive war against classified information leaks from within its normally well-secured walls. But there was a tipping point, just after Obama took office, when the administration decided something must be done about leaks.?

The New York Times' Sharon LaFranierre did a thorough report on the origins of the administration's crackdown on national security leakers. The answer lies somewhere in a combination of new faces running national security and a series of embarrassing leaks that happened immediately after the Obama administration was installed. It was a perfect storm that led to this war on leaks we've heard so much about.

Under Obama's former director of national intelligence,?Dennis C. Blair, the war against leaks started just after the new President took office. It became very clear, very early that they had a leaking problem on their hands.?

According to Mr. Blair, the effort got under way after Fox News reported in June 2009 that American intelligence had gleaned word from within North Korea of plans for an imminent nuclear test ? a disclosure that eventually led to the indictment of Mr. Kim. The report infuriated the Central Intelligence Agency not only because it indicated that the United States was privy to the private discussions of North Korean leaders, but also because it was broadcast mere hours after a classified report with that information had been distributed to intelligence officials.

The immediate leaking of such important intel combined with the new faces running national security pushed an aggressive assault on leaks to the forefront. The way the government was looking at leaks had already started to change. During Blair's first few months in office, he ordered a review of the cases brought against government officials for leaking national security threats during George Bush's second term. There were 153 cases and no indictments. Some cases had suspects that were never charged. A fraction of the cases were turned into FBI investigations.??"He was dismayed by what he found," the Times reports.

And that's when things started to change within the administration. "A tipping point was reached in 2009," one source told the Times. Blair, FBI director Robert Mueller and Attorney General Eric Holder were being scolded in private meetings with Senate leaders, like Sen. Dianne Feinstein, for the continued torrent of leaks. "We had to do 50 push-ups and promise to do better," Blair told LaFranierre. Blair's response was to put his right-hand man,?Robert M. Bryant, his counterintelligence executive, in charge of stopping leaks. They also trimmed the investigation review period from a few months down to three weeks. Whether or not their efforts are producing results, beyond twice as many prosecutions as all previous administrations combined, is up for some debate.?

On Friday, Times reporter James Risen was ordered to testify against one of his alleged sources. The government believes CIA official Jeffrey Sterling was the person who leaked classified information about a U.S. plan to pass bad information to Iran. The information, which was classified, ended up in a report and subsequent book written by Risen.

The Department of Justice is also investigating Marine General James Cartwright for allegedly leaking information about the Stuxnet virus to The New York Times' David Sanger. You also may have heard about the cases against Wikileaks source Bradley Manning and the former?National Security Agency contractor, Edward Snowden, who leaked classified documents to the Guardian and Washington Post. A few weeks ago, NSA head Keith Alexander?told ABC's?This Week?that "clearly the system did not work."

The administration is leading an unprecedented war on leaks, to varying degrees of success.?

To pass into legend is a fate most men yearn for although many seldom achieve, no matter how gallant or honourable only a fair few will have their names remembered in history. For the men of Seabel not many will have this honour despite their bravery and sacrifice, for life is cruel when you are living but death can be crueller for who will remember you? Your children will, yes. Your grandchildren will, most probable. But sooner rather than later your name will cease to fall from their lips, your memory extinguished and your sacrifices unknown; you will become one of the forgotten.

I suppose I am starting on a rather solemn point, but it is a poignant one nonetheless, for our story is about two families both shrouded by hate and blinded by power, they will tear a country apart, loose those they hold dear and all in the name of a throne. Ah-but not just any throne, a throne stained red by the blood of thousands, a throne hardened by the clashing of swords, a throne to the country of Seabel. It was a prize that much is true but the true story has been clouded over the years, each generation adding a new twist, a new hero?a new villain. What is fact and what is myth is hard to distinguish, but I am here to tell you the truth; to tell you the tale of Seabel?s bloodiest period in history; a story of war, love and betrayal, it may seem to be part of a ballad but I assure you this is the truth behind the forging of Seabel?s future; but to get to the present I must begin in the past and so begins the journey of our tale?

Seabel is a powerful Island nation, who?s history stretches back thousands of years to a time when man still lived in mud huts and were considered savages or barbarians, these were simple people who lived off the land, whom thought he world ended at their shores. That was until the ?First Few? arrived off the North-Western coast, from a land across the Black Sea called Halla, bringing with them education, innovations and new religions. The new settlers did not conquer but rather integrated in with the ?Old Ones? taught them new things, educated them and slowly but surely the inhabitants of Seabel began to develop.. These,? first few? managed to turn a untamed island into one of the most desired Kingdoms of the old world; however this did not come without sacrifice. Many battles were fought on land and sea for power over Seabel, a strategic stronghold for any country wanting to conquer more land, no more so than between the people of Seabel and the people of Luxor, who?s feud has seemingly been taking place since the original settlers and has continued onwards. Over the years many King?s have devised peace treaties with Luxor and many have been broken, their relationship was and remains fragile, friendships do not last long and treaties even less.

However this is not the only problem Seabel face as the country its self has in recent years become divided between two regions; the North and the South, dividing the country in half by war. History will come to know this period as the ?Dynastic Wars? where supporters of two rival branches of the House Davenport fought over the crown of Seabel. The two great Houses of Lancaster and Rayleigh have had a feud stretching centuries, both having claims to the throne, skirmishes between supporters have happened in the past but now war reins over Seabel as these families vie with blood for their head to sit upon the throne.

When the Old King Tiberius died leaving no living male heirs, the throne went to one of his nephews, either Robert Lancaster or Harold Rayleigh?Robert ascended the throne and thus the feud began. Although rivals and competitors for the throne the Rayleigh?s remained at court with the Lancaster?s, both buying their time, waiting for the opportune moment to strike. The moment came Francis Rayleigh was executed for treason by King Harold Lancaster, Francis?s son, Charles rode South with his family back to his family?s estate and waged war on House Lancaster.

Many battles were fought and lost until King Harold was slain by Charles in the Battle of Mountains Pass and soon after seized the countries capital of Briar, driving the Lancaster?s and their supporters to exile in the North and the Rayleigh?s became the reigning family. To add another twist to the tale the two Queens? are sisters, their marriages dividing a family in two, forever dividing them as enemies.

Lying in wait in the furthest northern cities, the Lancaster army are preparing once again, the new King James has rallied his supporters both old and new and prepares to march south to reclaim his throne. Soon Seabel will once again be thrown into a Civil War and the country stands at its most pivotal point in history; thousands will dies, neighbour will turn on neighbour, brother upon brother in a war which will define a country.

Israel, PA to Meet; PM Vows Referendum

U.S. Secretary of State John Kerry announced that Israeli and Palestinian negotiators will meet in Washington this week for the first time in three years, "if everything goes as expected."

Kerry has been pushing hard for a resumption of talks, making six visits to the region since he became Secretary of State earlier this year.?

Israeli Prime Minister Benjamin Netanyahu said in Sunday's cabinet meeting that any agreement reached at the negotiating table involving the creation of? Palestinian state?will be put to a national referendum.? It would be the first time in modern Israel's 65-year history that voters would have the final say in the outlines of a two-state solution.

"I believe that this is crucial," Netanayhu said.? "I don't believe that decisions such as this can be taken--if a deal is reached--with one coalition or another, but rather this thing needs to be brought to the nation to decide."

Netanyahu issued a statement Saturday describing the peace process as being in Israel's vital strategic interest.? The prime minister faces stiff?resistance from within his?governing coalition and even within his own party,?against conceding more territory to the Palestinians at the bargaining table.

The Palestinians under President Mahmoud Abbas have refused to recognize Israel's right to exist as a Jewish state.??

The Palestinian Authority also insists that talks resume from a starting point of Israel returning to pre-1967 borders, essentially forfeiting the territory Israel conquered in the Six-Day war.? Israeli leaders have branded that?a "non-starter."

Aides to Abbas told?The Times of London that the Palestinian leader received a letter from Kerry stating that the 1967 borders would be the basis for negotiations and that Israel would enact a construction freeze in Jewish communities in Judea and Samaria (the West Bank).

That report has been denied by Israeli officials in Jerusalem.?

Palestinians?have?reportedly agreed not to carry?out activities against?Israel in international institutions for nine months.? That would include advancing their bid for statehood in the United Nations independent of the bargaining table.

Israel has agreed to release 85 Palestinian prisoners who have been held since before the signing of the Oslo Accords in 1993.? Some of them were directly involved in the killing and wounding of Israelis.

Netanyahu described Israel's objectives in renewing talks with the Palestinians as "preventing the creation of a bi-national state between the Jordan River and the sea, which will endanger the future of the Jewish state, and preventing the creation of another Iranian-backed terror state within Israel's borders, which could no less endanger us."

NEW YORK (AP) -- A look at the 10 biggest volume decliners on New York Stock Exchange at the close of trading:

GS GSCI ETN 2037 : Approximately 1,700 shares changed hands, a 90.0 decrease from its 65-day average volume. The shares fell $.17 or .3 percent to $47.95.

Haverty Furniture Cos. class A : Approximately 100 shares changed hands, a 94.6 decrease from its 65-day average volume. The shares rose $.40 or 1.5 percent to $27.00.

Hubbell A : Approximately 100 shares changed hands, a 86.7 decrease from its 65-day average volume. The shares rose $.06 or .1 percent to $94.63.

Knot Offshore Ptrs : Approximately 7,600 shares changed hands, a 85.3 decrease from its 65-day average volume. The shares fell $.34 or 1.4 percent to $23.60.

Nuveen North Carolina Premium Income Municipal Fund : Approximately 6,700 shares changed hands, a 82.9 decrease from its 65-day average volume. The shares fell $.09 or .7 percent to $12.57.
