Lawmakers require VA to track effects of burn pits

WASHINGTON (AP) ? J.D. Williams didn't think much about the smoke cloud that often shrouded his air base in Iraq. Not when it covered everything he owned with black soot or when his wheezing and coughing made it difficult to sleep at night.

"We just went about our business because there was a war going on," said Williams, a retired chief warrant officer who was responsible for maintaining some 250 aircraft for the U.S. Army's 101st Airborne Division.

He returned home from that second stint in Iraq in 2006 and subsequently was diagnosed with an irreversible lung disease that his doctor suspects could be related to smoke from one of the hundreds of burn pits that dotted Iraq and Afghanistan during the course of the two wars. The pits were used to burn off the garbage that accumulates at military bases, everything from Styrofoam and metal to paints, solvents, human waste and medical waste.

A new Department of Veterans Affairs registry, mandated by Congress, will be used to try to determine if there is a link between the burn pits and long-term health problems.

Military personnel who were stationed near an open burn pit can sign up. Researchers will use the database to monitor health trends in participants, and the VA will alert them to major problems detected.

Over the long term, the findings could make it easier for veterans who served near burn pits to obtain disability payments.

Williams, 56, of Huntsville, Ala., was initially told that he would have to prove that his illness, diagnosed as constrictive bronchiolitis, was service-related. He walked out of the room. Eventually, after he traveled to Washington and met with members of Congress, the VA increased his disability rating 10 percent.

He said he's hoping the registry will pave the way for other soldiers to avoid a similarly exasperating process. If researchers find certain illnesses are linked to exposure to burn pits, then the VA would be more likely to declare those illnesses a presumptive condition, eliminating the need for a veteran to prove that his or her illness is service-related.

Sixty-three burn pits were still being used in Afghanistan as of Dec. 26; those in Iraq were closed by December 2010. Camps with fewer than 100 people are not required to report the use of a burn pit, so there could be more, but generally much smaller ones. Proponents say the burn pits were so widespread that the large majority of veterans from Iraq and Afghanistan could participate in the registry.

In 2009, the military updated its policies on burn pits to prohibit the burning of hazardous materials such as certain medical waste, batteries and tires, and whenever possible, to situate them where the smoke would not blow over work and living quarters.

"When our service members voice concerns about burn pit exposures as well as other health issues, we take our responsibility seriously to investigate these exposures and possible health risks, and to implement any protective measure that are indicated and feasible," said Defense Department spokeswoman Cynthia O. Smith.

The creation of the burn pit registry has been several years in the making.

Air Force Lt. Col Darrin Curtis said in a memo disclosed by the Army Times in 2008 that he believed a particularly large burn pit at Joint Base Balad, one of the largest air bases in Iraq, was an acute health hazard, and he was amazed that it was allowed to operate without restrictions.

Congressional hearings followed that featured sick veterans, contractors and family members who had lost a loved one from illnesses they attributed to burn pits. The Pentagon said that none of the monitoring conducted at Balad identified an increased risk for long-term health problems. It has maintained that position over the years but also acknowledges that some personnel have persistent symptoms, possibly as a result of elevated exposures to the smoke, existing health conditions or other unknown factors.

An Institute of Medicine study requested by the VA and made public in 2011 concluded there was insufficient data to determine whether burn pit emissions had long-term health consequences. The study found the pollutants measured at Balad were generally present at a concentration so low that it would not be expected to cause any harm, even if a person was exposed to that concentration for a lifetime. The two exceptions were particulate matter and acrolein.

Particulate matter is a mixture of small particles and liquid droplets that can lead to acute respiratory problems. But the high concentrations at Joint Base Balad came primarily from local sources such as traffic and dust storms, rather than the burn pit, according to the institute, which advises the government on health issues.

Acrolein is a liquid primarily used as a herbicide and in making other chemicals. Exposure can lead to eye, nose and throat irritation. Although the concentration exceeded precautionary levels set by the Environmental Protection Agency, it was still far below the concentration that led to nasal and lung damage in laboratory animals, the study said.

The Pentagon said it is continuing to study the potential hazards of burn pit exposure.

The VA opposed the legislation setting up the burn pit registry even though it has registries for those exposed to Agent Orange in Vietnam and for those who served during the Gulf War. The department did not oppose trying to track potential burn pit-related illnesses, just the mechanism proposed.

"We said it was not the best scientific approach for learning about long-term health outcomes and it really wasn't necessary for outreach because we have other programs in place," said Dr. Paul Ciminera, director of the VA's Post-9/11 Era Environmental Health Program.

As to whether the burn pits lead to health problems in soldiers, Ciminera cited the Institute of Medicine report. "We need to do further research to see what the long-term effects could be," he said.

Democratic Sen. Tom Udall of New Mexico, the lead Senate sponsor of the registry legislation, said he pushed ahead despite VA objections because the department seems to instinctively reject concerns that veterans are harmed by their surrounding environment. He cited Agent Orange as an example and said the VA initially resisted a link between the defoliant and the health of soldiers who served in Vietnam.

Many supporters of the registry, including Williams, are also participants in a class-action lawsuit filed against KBR Inc., which contracted with the government to operate several of the burn pits in Iraq and Afghanistan. Some 50 lawsuits were consolidated into one case in a Maryland federal court. The plaintiffs are seeking damages for various injuries, emotional distress and fear of future disease. KBR is seeking to dismiss the lawsuits on grounds it deserves the same immunity that prevents the plaintiffs from suing the federal government.

"Every type of waste imaginable was and is burned in these pits," the plaintiffs said in their lawsuit.

Veterans groups were big backers of the registry, and an often-divided Congress overwhelmingly sides with them rather than the VA.

"You've been told since you're a little kid: 'Don't put a Styrofoam cup in a fire and breathe it because it's bad for you," said Ray Kelley, national legislative director for the Veterans of Foreign Wars. "They do that all day long on these stops along with Lord knows what else, from human waste to all sorts of garbage. You're inhaling that on a daily basis. It can't be good for you."

Former NYC mayor Koch released from hospital

NEW YORK (AP) ? Former New York City Mayor Ed Koch (KAHCH') is back home after a weeklong stay in a hospital.

The 88-year-old Koch was admitted to NewYork-Presbyterian/Columbia hospital last Saturday with fluid in his lungs and swollen ankles.

He had been originally set to be released Monday, but his doctors sent him home early on Saturday.

Koch says he was delighted to go home. He says he expects to be back in his office at the beginning of the week.

Doctors have told Koch to reduce his salt intake.

Apple today announced their financial results for Q1 2013, the typically lucrative holiday quarter, and it includes 47.8 million iPhone, 22.9 million iPads, 12.7 million iPods, 4.1 million Macs and $46.3 billion in revenue. Apple's executives said:

?We?re thrilled with record revenue of over $54 billion and sales of over 75 million iOS devices in a single quarter,? said Tim Cook, Apple?s CEO. ?We?re very confident in our product pipeline as we continue to focus on innovation and making the best products in the world.?

?We?re pleased to have generated over $23 billion in cash flow from operations during the quarter,? said Peter Oppenheimer, Apple?s CFO. ?We established new all-time quarterly records for iPhone and iPad sales, significantly broadened our ecosystem, and generated Apple?s highest quarterly revenue ever.?

Judge Approves $844M Financing For Kodak To Exit Bankruptcy ...

Kodak has had a rough go of it lately, filing for Chapter 11 Bankruptcy almost a year ago and selling off its portfolio of more than 1000 digital imaging patents just last month.

But today the centenarian company has some good news to report, as U.S. Bankruptcy Court Judge Allan Gropper of the Southern District of New York has approved Kodak?s $844 million financing led by Centerbridge Partners LP.

This hinged on the sale of Kodak?s massive digital imaging portfolio for more than $500 million, which went through for $525 million from a consortium of tech giants. Buyers included Microsoft, Google, Apple, RIM, Facebook, HTC, Adobe, Amazon, and Samsung, to name a few.

Essentially, the majority of the major players in digital imaging (in a new, mobile world) will have access to the technology in some way. This is obviously good news for just about everyone but Kodak, who originally valued the patent trove at $2 billion.

But it seems the worst part may finally be over.

Here?s what CEO and Chairman Antonio Perez said in a prepared statement:

The Court?s approval of this financing commitment puts Kodak in a strong position to emerge from Chapter 11. This agreement, in conjunction with the recently approved sale and licensing of our digital imaging patent portfolio, lays the financial foundation for our Plan of Reorganization and a successful emergence from Chapter 11 as a profitable and sustainable company. Taken together, these accomplishments, along with other recent developments, such as the resolution of certain of our legacy liabilities, demonstrate the tangible and meaningful progress Kodak is making as it moves through the final phase of its restructuring.

Of the $843.7 million in financing, Kodak says $640 million will be rolled over to help finance Kodak?s exit from Chapter 11 Bankruptcy. Some of the money will also go towards paying off an earlier bankruptcy loan from lenders like JPMorgan Chase & Co. and GSO Capital Partners for $950 million.

Vegan pizza, smoked salmon Oscars on offer at post-Oscars ball

LOS ANGELES (Reuters) - Hollywood's elite will chow down on vegan pizza and kale salad in addition to the traditional smoked salmon Oscars at the annual Governor's Ball after next month's Academy Awards ceremony, celebrity chef Wolfgang Puck announced on Tuesday.

Unveiling his menu for the year's biggest movie party, Puck said chicken pot pie with shaved black truffles, mini Kobe burgers, Japanese baby peach salad, steamed red snapper with Thai spice, Tuna Nicoise and his signature gold-dusted mini-chocolate Oscars also would be served.

Some 1,500 guests are expected at the ball immediately after the February 24 Oscars ceremony, including nominees such as George Clooney, Steven Spielberg, Jennifer Lawrence and Jessica Chastain.

Puck's menu could be the first chance for many of the attendees to eat since breakfast, as nominees and presenters stave off food in order to squeeze in to fitted gowns and tuxedos for the televised red carpet arrivals and ceremony.

"Nobody eats lunch that day, so by nine o'clock, anybody who would be on a diet is no longer on that diet," Puck said.

With Oscar-nominated films ranging from dramas to comedies and musicals, guests at the ball - the Academy's official celebration - will be dining on dishes just as varied.

"We have so many great nominated movies from 'Argo' to 'Les Miserables' to 'Silver Linings Playbook," Puck told Reuters. "It's a really great year for movies with lots of variety, so we are going to serve a variety of dishes."

Puck, who this year is marking his 19th year catering the ball, and chef Matt Bencivenga will serve over 50 dishes from hors d' oeuvres and entrees that will be served on small plates throughout the evening.

Gastronomical items will include Chinese, French, Italian dishes and others from Puck's many Los Angeles eateries.

The master chef told Reuters there will also be a strong focus this year on vegan dishes, including pizza, kale salad with grilled artichoke, and a beet salad with spiced walnut among others.

"If they don't find something to eat (among our dishes) then they are really finicky," joked Puck.

About 300 of Puck's staff will be in the kitchen and 650 on the dining room floor, which will be laid out with small tables and booths to create a party atmosphere rather than a black tie dinner, according to Puck.

Completing the setting will be a 120-foot (37-meter)chandelier hanging from the ceiling and an 18-foot (5.5-meter) golden Oscar as the centerpiece of the ballroom floor.

Puck said food preparation will start a few days before the event with the making of dishes like smoked salmon and tortellini, but "we cook everything as if we were cooking for an intimate party of 25 - everything at the last moment."

By midnight, Puck said the festivities would be pretty much over as attendees moved to other parties. That's when he'll get his first opportunity of the day to relax "and hang with a few people I know, and we sit around and have some good wine."

?Her funeral did not take place in Carson, Calif., and her casket was not closed at 9 a.m. exactly. She was not laid to rest. Lennay Kekua?s last words to Manti Te?o were not ?I love you,? ? Deadspin reported.

In fact, the girlfriend Te?o said he had visited never existed. Instead her identity has been tied to a male acquaintance named Ronaiah Tuiasosopo, a 22-year-old band leader at a church in Antelope Valley, Calif., and a member of a prominent NFL football family.

Mr. Tuiasosopo at one point had the picture used by the Lennay ?catfish,? which turned out to be a photo of a classmate who had nothing to do with the fraud. When confronted about using the image, BuzzFeed reports, Tuiasosopo ?acted weird? and the picture disappeared off the Internet.

On Friday, ESPN quoted an unnamed friend of Te?o as saying that Tuiasosopo tearfully confessed to the hoax in early December, saying that at first he was just playing a ?game? on Te?o but also acknowledging he had engaged in catfishing before.

According to ESPN, the friend, a woman in her mid-20s, said Tuiasosopo told her that Te?o ?was not involved at all, he was a victim.?

On Wednesday, Te?o expressed his ?incredible embarrassment? and called it a hoax, though he had continued to talk about Kennau as his girlfriend even after he informed the university that he had been a victim of fraud.

Those willing to exploit the vulnerable goodwill of others have always been hanging around the fringes of society, of course, but the social media age has given the practice a different and disturbing spin: It?s as if the very anonymity of the Internet morphs into a tendency toward faith in other people.

?There is a widespread sense, perhaps untrue, that people can be most ?real? when they are most hidden ? that all of us are Cyranos who can only speak our true minds when our faces and names are invisible. It?s a lovely notion ? [but] it makes us oblivious to flaming red flags,? the Washington Post?s Monica Hesse wrote Thursday.

Both must be represented within the strategic plan in order for the programs comprised in the strategy to be realistic (and not be set aside or discovered to be impossible to implement during execution).

This tension represents a dichotomy that feels awkward and yet makes sense. There will always be tactical short-term work to be accomplished that sets the stage for the larger strategic initiatives. That is the conflict. Get the boring stuff done now, even though the entire organization is impatient to see more grandiose progress made and get on with longer-term strategic programs that must be implemented. The dusty dirt road must be paved in order to achieve the fast, smooth ride in the sports car ? otherwise the trip will be slow, fraught with challenging conditions and be anything but smooth.

Think of the tactical elements of the plan as accomplishing deferred organizational maintenance, if that helps. What is the point of replacing the roof overhead if the walls are cracked and crumbling? As much as we try to stretch our limited resources, the fact remains that they?re still limited. Choosing to address tactical impediments (see Managing Assumptions, Risks and Impediments In Strategic Planning) to strategy implementation isn?t a negative thing; it merely reflects the fact that we must select the right opportunities (targeted outcomes) that will earn our limited energy and resources in some sort of logical sequence. Certain elements of our strategy are dependent on having organizational impediments addressed in order to pave the road for faster progress later on in the process.

Set Priorities

Prioritization is a fundamental component of the cognitive decision-making process and comes into play when selecting strategic priorities in business, based upon the outcomes that are sought through the organization?s strategy. As such, it is essential to have prioritization tools to draw upon in strategic planning and at our disposal for making routine business decisions. Prioritization goes hand-in-hand with understanding the relative value of each strategic opportunity and its associated outcomes that we have available to us to select from. Opportunity valuation removes bias from our decision making and prioritization combats the behavior of many organizations that bite off more than they can chew and suffer for it later.

A strategic prioritization process helps focus your resources and energy on your best opportunities and set the others aside for the time being.? In the face of competing corporate agendas, a strategic valuation and prioritization system is essential in selecting the right opportunities to pursue at this time and for providing justification for management?s choices. As such, prioritization is a vital part of an effective corporate planning process.

CSF #1:?Do a current-state analysis before jumping into future-state planning

A common mistake organizations make during strategic planning is that over jumping directly into planning for the future. The holistic understanding of the business ecosystem that comes from having conducted a current-state analysis first allows for strategic planning to optimize the shortest path to the future-state, once it has been defined. That path is dependent upon an understanding of the business?s core values, culture, value proposition, organizational value quadrants, org structure relative to culture and external competitive environment by line-of-business (including key players like customers, suppliers, partners and channel relationships). The comparison of the organizational profile to the challenges identified during this step result in the gap that serves as the basis for planning.

CSF #2:?Engage Employees Across the Organization In Strategic Planning

Strategic planning requires ?real? information related to questions like:

  1. What is working well?
  2. What is not working so well?
  3. What are our organizational vulnerabilities?
  4. Where are there untapped opportunities?

To get to this information straight from the source that knows it best, employees must be engaged in the strategic planning process as early as the current-state analysis.

CSF #3:?Align strategy with mission, operational tactics and business processes

If organizations cannot succinctly explain what they do, how will their marketplace consumers understand it??An organization?s mission statement must be defined broadly enough to allow room to maneuver, yet be direct and purposeful in defining the market(s) served, the products and / or services provided by the firm and the distinguishing characteristics of those offerings.

Operations-level planning describes the tactics of execution, correlating strategy to action. Misalignment often occurs here, primarily because companies skip over operational planning altogether or do a poor job of paying attention to details. This activity has an important alignment to budgets, as it affects business process, resource plans, infrastructure and schedules that might have downstream consequences to sales, marketing and other functions.

CSF #4:?Align strategic goals with metrics, measures

Closely linked to business process considerations are the metrics and measures of process effectiveness. Again, this relationship forces a close alignment with strategy ? more specifically with the strategic goals related to the strategy. As described in Part-2 of the series, the relationship of strategic goals to metrics and measures can be tricky. Setting the wrong metrics might help accomplish one goal, but simultaneously compromise another.

CSF #5:?Implement strategy governance and keep it simple

Governance and strategy are inexorably linked during planning and in the midst of execution ? therefore alignment of these two business components is critical.? Governance must first exist, then it must be aligned to planning in order to build in realistic strategic expectations and to measurement cycles in order for real accountability to exist. These are required in strategic planning and strategy execution. Governance should address, at a minimum: master scheduling, metrics and measurements, plan rejuvenation, project planning and plan accountabilities.

Governance (including metrics, measuring and managing problems as they impede execution) is at the root of many strategy implementation issues. Too often, there is little follow-through to ensure that the strategic plan is fully executed.

CSF #6:?Utilize a Change Management program throughout strategy implementation

There is a subtle reason responsible for the vast majority of organizational struggles with execution. It has to do with failing to properly manage change. That failure may be the result of not engaging employees in the planned transformation, from overly complex plans or changes that are introduced too quickly and ambitiously and therefore begin to unravel during execution. Once a strategic plan has been developed and approved, there should be communication occurring throughout the organization to inform employees of the strategy and what it means to the organization and to them personally. Strategies can fail simply because they don?t get communicated to all the people involved.

CSF #7:?Align the strategy and goals with the organization?s culture and core values

The core values of an organization are the foundation of the corporate culture. Setting goals that are unrealistic and are sure to violate any core values represents an alignment issue.

Organizations with strong cultures rooted in shared core values tend to have much happier employees. The more strongly defined the organization?s core values, the more likely that this value system will serve as a code of conduct that promotes and guides strategically-aligned behaviors within managers and employees.

CSF #8:?Do not overlook short-term organizational fixes that must be addressed in order for long-term success to occur

Both tactical and strategic programs must be represented within the strategy if the organization is to have realistic expectations of executing the strategic plan. Prioritization is a fundamental component of the planning process and comes into play when selecting strategic priorities in business, based upon the outcomes that are sought through the organization?s strategy.
